Utility model patents — petty patent, difference from patent, TRIPS, MSME innovation, India policy — UPSC GS III notes.

India spends around 0.7% of GDP on R&D — roughly one-third the global average and one-fifth of China's. Economic Survey 2019-20 and successive reports have pushed for a Utility Model regime — often called a "petty patent" — to protect the incremental and minor innovations that Indian MSMEs, students and traditional artisans produce every day. Germany, Japan, Korea, China have it. India does not. For UPSC GS III, the Utility Model is a niche but high-frequency exam topic under IPR, innovation and economy.

Patents — The Baseline

A patent is a statutory right for an invention granted for a limited period. Under the Indian Patents Act 1970, a patent requires:

Once granted, the holder has exclusive monopoly over making, using, or selling the invention for 20 years (WTO TRIPS minimum).

After expiry, the invention enters public domain.

What is a Utility Model

A Utility Model protects "minor inventions" that may not meet the full novelty-and-inventive-step threshold of a patent. Key features:
