भारत के Solicitor General: भूमिका और rank
Solicitor General of India का constitutional status, appointment, tenure, duties, restrictions और Attorney General से असली अंतर इस guide में जानिए।
किसी बड़े constitutional case पर newspaper report खोलिए और आम तौर पर बहस करते हुए Solicitor General ही दिखेंगे। वे बड़े मामलों में आते हैं, Union की ओर से बोलते हैं और reports इस पद को constitutional institution जैसी गंभीरता देती हैं। इसलिए aspirants का एक reasonable अनुमान बनता है: संविधान में इस पद को बनाने वाला कोई Article ज़रूर होगा, शायद Article 76 के आसपास।
ऐसा कोई Article है ही नहीं। यही इस page का सबसे उपयोगी fact है, क्योंकि इससे सवालों के एक पूरे family का answer बदल जाता है। Constitution Union के लिए ठीक एक law officer का नाम लेता है: Attorney General, Article 76 में। Solicitor General का संविधान में कहीं ज़िक्र नहीं है। Article 76 में भी नहीं, कहीं और भी नहीं। पद असली है, senior है और powerful है, लेकिन इसकी नींव Constitution में नहीं, government द्वारा बनाए गए rules में है। इस पद के बारे में बाकी हर बात इसी से निकलती है।
Solicitor General of India कौन होते हैं?
Solicitor General of India Union के दूसरे सबसे बड़े law officer होते हैं। वे Attorney General से नीचे rank करते हैं और उनके काम में मदद करते हैं। उनके नीचे Additional Solicitors General काम करते हैं। अगर पूरी shape एक sentence में चाहिए, तो Attorney General government के chief counsel हैं, Solicitor General उनके deputy हैं जो courtroom का बहुत-सा भारी काम करते हैं, और Additional Solicitors General अलग-अलग benches, High Courts और subject areas में काम बाँटते हैं।
यह पद पुराना है और दोनों top posts के बीच आने-जाने का रास्ता पहले से बना हुआ है। C.K. Daphtary 1950 में India के पहले Solicitor General बने। वे पहले Attorney General M.C. Setalvad के साथ काम करते थे और फिर 1963 से 1968 तक खुद Attorney General बने। ऐसा pattern दोबारा भी दिखा। Soli Sorabjee 1977 से 1980 तक Solicitor General रहे और बाद में दो बार Attorney General बने। G.E. Vahanvati 2004 से 2009 तक Solicitor General रहे और फिर 2009 से 2014 तक Attorney General बने। व्यवहार में Solicitor General की chair Attorney General of India के लिए मुख्य waiting room जैसी है।
लेकिन “second-highest law officer” rank के बारे में है, constitutional status के बारे में नहीं। ये दो अलग सवाल हैं। इन्हें मिला देना ही वह गलती है, जिसे यह topic पकड़ता है।
अधिकतर notes की सबसे बड़ी ग़लती: यह constitutional post नहीं है
Solicitor General statutory और government post हैं, constitutional post नहीं। Article 76 Attorney General का पद बनाकर रुक जाता है। इसमें Article 76(2) में Attorney General के duties, Article 76(3) में India के सभी courts में audience का right और Article 76(4) में President के discretion पर remuneration का ज़िक्र है। Article 88 उन्हें Parliament के किसी भी House, joint sittings और जिस committee में नामित किया जाए उसकी proceedings में vote के बिना बोलने और हिस्सा लेने का अधिकार देता है। Article 105 उन्हें MP के privileges देता है।
अब यही list Solicitor General के लिए चलाइए। बनाने वाला कोई Article नहीं। कोई constitutional duties नहीं। Article 76(3) वाला right of audience नहीं। Article 88 के तहत Parliament को address करने का right नहीं। Article 105 के privileges नहीं। इनमें से कुछ भी Solicitor General को नहीं मिलता, क्योंकि colleague के constitutional rights विरासत में नहीं मिल सकते। Attorney General ये rights अपने नाम पर, Constitution द्वारा बनाए गए office की वजह से रखते हैं।
तो यह office आता कहाँ से है? Law Officers (Conditions of Service) Rules, 1987 से, जिन्हें government ने बनाया है। ये Rules बताते हैं कि “Law Officer” कौन है और इस definition में ठीक तीन posts आती हैं: Attorney General, Solicitor General और Additional Solicitors General। Solicitor General के अस्तित्व, terms, tenure और restrictions का source यही है।
इस section से यह sentence साथ ले जाइए और एक बार ज़ोर से बोलिए: Solicitor General of India की कोई constitutional duties नहीं हैं। उनकी duties Rules और उस government से आती हैं, जो उन्हें engage करती है। यह technicality तब तक छोटी लगती है, जब तक आप नहीं देखते कि इससे एक साथ कितने सवालों का answer मिल जाता है।
Office कहाँ से आता है: Law Officers (Conditions of Service) Rules, 1987
1987 Rules इस office का छोटे अर्थ में constitution हैं। ये चार काम करते हैं: Law Officer की definition देते हैं, term तय करते हैं, fees सहित service conditions तय करते हैं और private practice पर restrictions लगाते हैं।
Tenure के बारे में Rules तीन साल का term देते हैं, जब तक term बढ़ाया न जाए या resignation अथवा government के decision से appointment पहले ख़त्म न हो। इसकी तुलना Attorney General से कीजिए। Constitution उनका tenure बिल्कुल तय नहीं करता। Article 76(4) सिर्फ़ कहता है कि वे pleasure of the President के दौरान office में रहते हैं, यानी Union government के decision तक। यहाँ एक सचमुच उलटा दिखने वाला नतीजा है। Junior post का written term है, जबकि senior constitutional post का नहीं। यह backwards लगता है, और है भी, क्योंकि दोनों offices की नींव अलग है। Rules term पर specific हो सकते हैं। Constitution ने specific होना चुना ही नहीं।
Remuneration पर Rules fee schedule देते हैं। Law officers अपने काम के लिए paid होते हैं और यह payment Union government के expenditure में दूसरे legal bill की तरह आती है। यह Consolidated Fund of India पर charged नहीं है, जैसा Supreme Court judges और Comptroller and Auditor General की salary Article 112(3) के तहत होती है। यह accounting का मामूली अंतर नहीं है। Charged expenditure किसी office को annual vote से बचाने के लिए होता है। किसी ने government के अपने lawyer को government से बचाने की ज़रूरत नहीं समझी।
इस पूरी व्यवस्था का administrative home Ministry of Law and Justice के Department of Legal Affairs में है। Law officers को engage करने के proposals, opinions की requests और departments के references इसी के रास्ते चलते हैं।
Solicitor General की appointment कैसे होती है?
Solicitor General को Appointments Committee of the Cabinet, यानी ACC, appoint करती है। इसकी अध्यक्षता Prime Minister करते हैं और इसमें Home Minister शामिल होते हैं। Additional Solicitors General की appointment भी यही committee clear करती है। Ministry of Law and Justice proposal आगे बढ़ाती है और ACC उसे approve करती है।
इसकी तुलना Article 76(1) के तहत President द्वारा appointed Attorney General से कीजिए। President Union Council of Ministers की advice पर काम करते हैं। असल में दोनों appointments political executive ही करती है। लेकिन form बिल्कुल अलग है: एक head of state की constitutional appointment है, दूसरी Cabinet committee का administrative decision। जब question पूछे कि Solicitor General को कौन appoint करता है, तो answer Appointments Committee of the Cabinet है, President नहीं। यह distinction तब तक pedantic लगती है, जब तक इसके कारण mark न चला जाए।
Eligibility की कोई constitutional clause भी नहीं है, क्योंकि Constitution इस post का नाम ही नहीं लेता। Article 76(1) Attorney General के लिए कहता है कि वे Supreme Court के Judge बनने के लिए qualified हों। Article 124(3) के अनुसार इसका मतलब High Court judge के रूप में पाँच साल, या High Court advocate के रूप में दस साल, या President की राय में distinguished jurist होना है। Solicitor General के लिए ऐसा constitutional bar नहीं है। व्यवहार में government substantial Supreme Court practice वाले senior advocate को appoint करती है, क्योंकि इस काम को उसके बिना संभालना मुश्किल है। लेकिन यह hiring norm है, constitutional condition नहीं।
Solicitor General असल में क्या करते हैं?
Rules के तहत Solicitor General की core duty Attorney General की मदद करना और Union government द्वारा दिया गया legal work करना है। व्यवहार में यह तीन हिस्सों में बँटता है।
पहला, Union के cases पर बहस करना। Solicitor General Supreme Court और High Courts में Government of India की ओर से आते हैं। बड़े मामलों में अक्सर Attorney General के बजाय वही lead voice होते हैं। काम का यही दिखने वाला हिस्सा office को उसके paper status से बड़ा दिखाता है।
दूसरा, government को legal advice देना। Departments Ministry of Law and Justice के ज़रिए references भेजते हैं: क्या proposed step क़ानूनी है, क्या parent Act के तहत notification जारी हो सकती है, क्या यह rule challenge के बाद भी टिकेगा, और Union को judgment के ख़िलाफ़ appeal करनी चाहिए या उसे मान लेना चाहिए। Office का बहुत-सा असली influence यहीं रहता है, file के बाहर किसी को दिखाई नहीं देता।
तीसरा, जहाँ कोई law इस post का नाम सीधे लेता है, वहाँ statutory functions निभाना। लगभग हर notes इस हिस्से को छोड़ देता है, जबकि यही सबसे अच्छा proof है कि “not a constitutional post” का अर्थ “law में कहीं mentioned नहीं” नहीं है। Contempt of Courts Act, 1971 की Section 15 को देखिए। इसमें criminal contempt court खुद शुरू कर सकती है, या Advocate-General की motion पर, या Advocate-General की written consent वाले किसी दूसरे व्यक्ति की motion पर। Section का Explanation बताता है कि “Advocate-General” का मतलब क्या है। Supreme Court के संदर्भ में इसका अर्थ Attorney General या Solicitor General है। High Court के संदर्भ में इसका अर्थ state का Advocate General है। यानी Solicitor General के पास एक असली statutory gate है। वे Supreme Court में criminal contempt move कर सकते हैं, या किसी दूसरे व्यक्ति को लिखित consent दे सकते हैं। उस consent के बिना private citizen की contempt petition दरवाज़े से अंदर नहीं जा सकती।
Pattern पर ध्यान दीजिए। Parliament ordinary law के ज़रिए Solicitor General को जितनी चाहे power दे सकती है। लेकिन Article 88 के तहत House का floor या Article 76(3) वाला audience right नहीं दे सकती, क्योंकि ये Constitution में हैं और उस named office के साथ जुड़े हैं।
Law officer क्या नहीं कर सकता?
1987 Rules private practice को पूरी तरह रोकने के बजाय सीमित करते हैं। ये restrictions Attorney General पर लागू होने वाली broad restrictions जैसी ही हैं। Law officer government servant या salaried full-time employee नहीं होता, इसलिए Rules practice पर पूरी रोक लगाने के बजाय conflicts को अलग करते हैं।
मोटे तौर पर Rules के तहत Law Officer को ये काम करने की अनुमति नहीं है:
- किसी भी court में किसी भी party का brief लेना, सिवाय Government of India, state government या university, statutory authority अथवा government corporation जैसे public body के।
- Government of India या public sector undertaking के ख़िलाफ़ advice देना या brief लेना, या ऐसे matter में काम करना जिसमें Government of India की ओर से advice या appearance की ज़रूरत पड़ सकती हो।
- Criminal prosecution में accused व्यक्ति का defence करना, जब तक Government of India की permission न हो।
- किसी company या corporation के office में appointment लेना, जब तक Government of India की permission न हो।
- किसी Ministry, department, statutory organisation या public sector undertaking को advice देना, जब तक proposal या reference Ministry of Law and Justice के रास्ते न आया हो।
इन पाँचों को साथ रखिए तो logic साफ़ है: government lawyer का समय नहीं, उसका side खरीदती है। वह practice कर सकता है, लेकिन table के दूसरी तरफ़ नहीं मिल सकता और official channel के बाहर किसी department को चुपचाप advice नहीं दे सकता।
अब वह objection, जिसे पहले ही पूछ लेना चाहिए। अगर Union के top law officers private practice रखते हैं, तो क्या पूरा arrangement compromised नहीं है? यह genuine tension है और इसका answer साफ़ defence नहीं है। Alternative full-time ban होगा। तब job वही लोग ले पाएँगे, जिनकी protect करने लायक practice नहीं है। Union के सबसे कठिन constitutional cases पर बहस करने वाले व्यक्ति को चुनने के लिए यह ठीक filter नहीं है। इसलिए conflict को restriction से manage किया जाता है, हटाया नहीं जाता। जो इस design को बिल्कुल tidy बताता है, उसने इसे ध्यान से नहीं देखा।
Union law officers की hierarchy
Constitution में एक post, Rules के तहत दो, और उसके नीचे wider engagement layer। इसे पकड़ने के लिए table सबसे तेज़ तरीका है।

दो rows पूरा answer संभाल लेती हैं। Basis column constitutional और statutory का फ़र्क़ बताता है। Appointing authority column President और Appointments Committee of the Cabinet का फ़र्क़ बताता है। ये दो ठीक हैं तो बाकी padding है।
यही two-tier design state level पर भी दोहरता है। यह ध्यान देने लायक है, क्योंकि इससे दो topics एक हो जाते हैं। Article 165 state के Advocate General का office बनाता है और वहीं रुक जाता है। उसके नीचे Additional Advocates General, Government Advocates और Public Prosecutors state rules और ordinary law के तहत exist करते हैं। हर level पर एक constitutional law officer और उसके नीचे statutory support structure। Union और states, दोनों जगह pattern यही है।
“Not a constitutional post” होने से सच में क्या बदलता है?
इस label को एक minute के लिए serious होकर देखिए। यह trivia नहीं रहेगा। इसके तीन नतीजे हैं और इसी वजह से distinction ज़रूरी है।
इसे constitutional amendment के बिना बदला जा सकता है। 1987 Rules executive rules हैं। Government notification से term बदल सकती है, fee schedule बदल सकती है या law officer cadre को restructure कर सकती है। Attorney General के office को छूने के लिए Constitution amend करना पड़ेगा। एक office amendment procedure से protected है, दूसरा policy decision से कभी भी अलग हो सकता है।
Attorney General के constitutional rights का हिस्सा Solicitor General को नहीं मिलता। Solicitor General Lok Sabha में जाकर उसे address नहीं कर सकते। Court में उनकी seniority भी यह अधिकार नहीं बदलती, क्योंकि यह Article 88 से आता है और named office से जुड़ा है। Article 76(3) का right of audience भी इसी तरह काम करता है।
यह बताता है कि office कोई check नहीं है। Solicitor General उन independent constitutional bodies में नहीं हैं, जिन्हें executive को रोकने के लिए बनाया गया है। वे executive के advocate हैं, executive उन्हें engage करती है, pay करती है और हटा सकती है। यही design है। Court के officer के रूप में उनका काम judiciary के लिए महत्वपूर्ण है, लेकिन Rules की restrictions public के बजाय client की रक्षा करती हैं। अगर आप separation of powers map कर रहे हैं, तो law officers को diagram में executive की तरफ़ रखिए, चाहे Constitution उनका नाम ले या न ले।
इसे पढ़ें और याद कैसे रखें?
पूरे topic को एक contrast पर टिकाइए: Attorney General के लिए Article 76, बाकी सभी के लिए 1987 Rules। अगर आप यह sentence बोल सकते हैं और फिर कह सकते हैं कि “इसलिए Solicitor General की constitutional duties नहीं हैं”, तो answer की spine और पूछे जाने वाली चीज़ों का लगभग 80% आपके पास है।
इसके साथ चार facts जोड़िए। Appointment: Appointments Committee of the Cabinet, जिसकी अध्यक्षता Prime Minister करते हैं, President नहीं। Rank: Attorney General से नीचे दूसरा, Additional Solicitors General से ऊपर। Term: Rules के तहत तीन साल, जो Attorney General के term से ज़्यादा definite है, क्योंकि उनका tenure President की pleasure है और कोई fixed term नहीं। Parliament में rights: कोई नहीं, क्योंकि Article 88 सिर्फ़ Attorney General का है।
Restrictions को पाँच bullets की list की तरह याद मत कीजिए। Principle याद रखिए: government उनका side खरीदती है, hours नहीं। फिर bullets खुद बन जाएँगी। Government के ख़िलाफ़ brief नहीं, permission के बिना criminal defence नहीं, permission के बिना company office नहीं और Ministry of Law and Justice channel के बाहर advice नहीं। हर bullet इसी principle को अलग situation पर लगाती है।
Thin answer और अच्छे answer के बीच का detail statutory-functions वाला है। “Not a constitutional post” का अर्थ “law में mentioned नहीं” नहीं है। Contempt of Courts Act वाला example साथ रखिए। इससे साबित होता है कि Parliament ordinary legislation से Solicitor General को real power दे सकती है, जबकि Constitution चुप रह सकता है। एक example में पूरी architecture दिख जाती है।

Solicitor General यह याद दिलाने वाला अच्छा example हैं कि Constitution की ख़ामोशी information होती है, oversight नहीं। Framers ने Union के लिए एक law officer बनाया और बाकी government of the day पर छोड़ दिया, क्योंकि legal team administrative need है और administrative needs बदलती रहती हैं। Constitution ने अपने लिए वह एक office रखा, जो Union की ओर से उसके अपने नाम पर बोलेगा। उस office के rights, यानी हर court में audience और Parliament का floor, किसी और की पहुँच में नहीं रखे गए। इसलिए जब उसे ग़लत जगह ढूँढ़ना बंद करें, तो office बिल्कुल वैसा ही दिखता है जैसा है: government का सबसे अच्छा उपलब्ध advocate, उन्हीं terms पर engaged जिन्हें government लिखती है, देश का सबसे consequential legal work करता हुआ और तीन साल के renewable term पर। यह design की कमज़ोरी नहीं है। यही design है।
