Certiorari writ: गलत order को quash करने की remedy

Certiorari order pass होने के बाद legality की जाँच करती है। Jurisdiction, apparent error of law, natural justice और Article 226 का पूरा ढाँचा समझिए।

Certiorari वह writ है, जिसे लोग चुपचाप skip कर देते हैं। पाँचों में इसका spelling सबसे मुश्किल है, pronunciation भी और इसका Latin नाम यह संकेत भी नहीं देता कि यह करती क्या है। “You may have the body” से कम-से-कम body का पता चलता है। “To be certified” से कुछ नहीं पता। अगर आप कई हफ़्तों से यह शब्द सुनकर सिर हिला रहे हैं, लेकिन सच में समझे नहीं हैं, तो आप बहुत बड़े और sensible group में हैं। नाम जिस चीज़ का है, वह कठिन नहीं है। किसी junior body ने ऐसा order pass किया, जिसे pass करने का उसे अधिकार नहीं था। Senior court file मँगाती है, देखती है और order cancel कर देती है। Certiorari वही cancellation है। बाकी detail यह बताती है कि court ऐसा कब करेगी।

Certiorari का मतलब और काम

Writ of certiorari वह order है, जिसमें superior court inferior court, tribunal या quasi-judicial authority के सामने चली proceeding का record मँगाकर पहले से pass order को quash करती है। यह old English writ के phrase certiorari volumus, “we wish to be informed”, से आया है। इसलिए standard translation “to be certified” या “to be informed” है। Court नीचे क्या हुआ, यह जानना चाहती है। नीचे जो हुआ वह unlawful हो, तो उसे मिटा देती है।

यहाँ दो features पूरा काम करते हैं।

पहला timing। Certiorari order के बाद आती है। उससे पहले quash करने को कुछ है ही नहीं। यही इसे prohibition से अलग करती है, जो proceeding चलने के दौरान रोकती है। इसलिए certiorari curative या corrective और prohibition preventive कहलाती है। Bodies और defects वही, clock अलग।

दूसरा, court क्या करने से मना करती है। वह case दोबारा decide नहीं करेगी। Rent tribunal ने tenant के खिलाफ eviction order किया, लेकिन tenant को hearing की सूचना ही नहीं मिली। Natural justice साफ़ टूटी। Certiorari eviction order quash करेगी, tenant को हमेशा रहने का हक़ declare नहीं करेगी। Matter आम तौर पर fresh lawful hearing के लिए वापस जाएगा और tenant वहाँ फिर हार सकता है। बस इस बार ठीक तरीके से हारेगा। यही bargain है: certiorari lawful process देती है, favourable result नहीं।

एक analogy काम करती है, अगर उसकी सीमा भी याद रखें। Senior officer junior की file मँगाता है, देखता है कि junior के पास order pass करने की power थी या नहीं और rules follow हुए या नहीं। नहीं हुए, तो file फाड़ देता है। लेकिन senior officer उसी administrative chain में merits पर अपनी view लगा सकता है। Court ऐसा नहीं कर सकती। वह tribunal की boss नहीं है। वह chain के बाहर legality की supervisor है और यह role दिखने से ज़्यादा narrow है।

Supreme Court ने यह बात T.C. Basappa v. T. Nagappa (1954) में साफ़ कही: certiorari supervisory है, appellate नहीं। Court appeal में नहीं बैठती, evidence reweigh नहीं करती और यह नहीं पूछती कि वह अलग फैसला करती या नहीं। यही sentence आगे की लगभग हर limit का source है और इस writ को बाकी चार writs से अलग करता है।

Constitution में कहाँ है: Articles 32 और 226

दो doors फिर से। Article 32 Supreme Court तक और Article 226 High Court तक ले जाता है। दोनों certiorari की nature वाली writs को expressly name करते हैं। Article 32 fundamental rights enforce करने तक सीमित है। Article 226 fundamental rights के साथ any other legal right को भी cover करता है, क्योंकि इसमें “for any other purpose” है।

Certiorari में इसका practical असर mandamus जैसा है। Tribunal का flawed order आम तौर पर statutory right violate करता है, fundamental right नहीं। Wrong eviction order, rejected licence, service penalty या hearing के बिना tax assessment अपने-आप Part III violation नहीं हैं। Natural justice बहुत grossly टूटी हो, तो Article 14 का argument बन सकता है। इसलिए certiorari का practical home Article 226 है और Article 32 narrow door है।

अब वह distinction, जो writ list में नहीं है। Article 226 High Courts को writ jurisdiction देता है। Article 227 उनकी territory के सभी courts और tribunals पर superintendence की अलग power देता है। दोनों overlap करते हैं और अक्सर साथ plead होते हैं, लेकिन same नहीं हैं। इसी अंतर से modern writ law में एक sharp correction आया।

Surya Dev Rai v. Ram Chander Rai (2003) में two-judge bench ने कहा कि Article 226 के तहत subordinate civil courts के orders के ख़िलाफ़ certiorari हो सकती है। यह position 12 साल रही। फिर Radhey Shyam v. Chhabi Nath (2015) में three-judge bench ने उसे overrule किया और कहा कि civil courts के orders के ख़िलाफ़ certiorari नहीं होती। वजह structural है: civil court tribunal की तरह judicial hierarchy के बाहर inferior body नहीं है। उसे correct करने का High Court का tool Article 227 की supervision है, Article 226 की prerogative writ नहीं। इस topic से एक modern case ले जाना हो तो यही ले जाइए, क्योंकि बहुत-से study materials अभी भी 2003 की बात दोहराते हैं।

तीन grounds और केवल तीन

Certiorari तीन grounds पर जारी होती है: jurisdictional defect, record के face पर दिखने वाली error of law और natural justice का violation। Practice में list closed है। Syed Yakoob v. K.S. Radhakrishnan (1964) इसे सबसे साफ़ रखता है और इस topic में एक case याद करना हो तो यही करें।

Jurisdiction पहला और सबसे साफ़ ground है। Body के पास matter decide करने की power थी ही नहीं, या power थी लेकिन सीमा पार कर गई, या preliminary fact को गलत तय करके jurisdiction मान ली जिस पर उसकी authority निर्भर थी। Tribunal landlord-tenant dispute सुन सकता है, लेकिन दो ऐसे लोगों का dispute तय कर दे जो कभी landlord-tenant relationship में थे ही नहीं। उसने अपनी power देने वाला question गलत answer किया। Order जाएगा। इसका उलटा भी: body के पास jurisdiction हो और वह गलत तरीके से exercise करने से मना कर दे।

Record के face पर apparent error of law वह ground है जिसका misuse होता है। इसका अर्थ order wrong है, इतना नहीं। Error order में खुद दिखाई दे और उसे साबित करने के लिए elaborate argument न चाहिए। Satyanarayan Laxminarayan Hegde v. Mallikarjun Bhavanappa Tirumale (1960) में Supreme Court ने कहा कि error manifest और self-evident होना चाहिए। Repealed section लागू करना apparent error है। दो genuinely arguable readings में एक चुनना नहीं। Hari Vishnu Kamath v. Ahmad Ishaque (1955) ने भी कहा कि certiorari error of law तक जाती है, error of fact तक नहीं, और court order quash कर matter वापस भेज सकती है।

Fact और law की line पर marks और cases दोनों खोते हैं। Syed Yakoob सीधी बात करता है: finding कितनी भी erroneous हो, certiorari से correct नहीं होगी, क्योंकि evidence reappreciate करना appeal का काम है। एक narrow exception है। Finding पर कोई evidence ही न हो, तो यह error of law है, क्योंकि material के बिना decide करने वाली body अपने function से बाहर चली गई। Insufficient evidence काफ़ी नहीं। No evidence है।

Natural justice तीसरा और व्यवहार में सबसे busy ground है। दो rules इसे संभालते हैं। Nemo judex in causa sua, कोई अपनी cause में judge नहीं, bias और appearance of bias के लिए। Audi alteram partem, दूसरी side को सुनो, notice, real opportunity to respond और अब increasingly reasons वाला speaking order के लिए। Notice दिए बिना eviction order इस second rule पर fail है।

तीनों grounds में जो नहीं है, उस पर ध्यान दें। Court यह नहीं पूछती कि decision fair, wise या correct था। यही restraint judicial review और judicial activism के बीच फर्क बनाती है।

Certiorari किसके ख़िलाफ़ होती है?

Certiorari judicial और quasi-judicial bodies के ख़िलाफ़ होती है। Classic formulation Atkin LJ ने Rex v. Electricity Commissioners (1924) में दी: जिस body के पास rights affect करने वाले questions तय करने की legal authority है और judicially act करने की duty है, वह writ के अधीन है। India ने यह formula जल्दी अपना लिया। Province of Bombay v. Khushaldas Advani (1950) में Supreme Court ने कहा कि certiorari judicial और quasi-judicial functions तक जाती है, purely administrative तक नहीं।

Everyday respondents वही हैं जिनकी उम्मीद होगी: rent tribunals, service tribunals, judicial तरीके से काम करने वाले revenue और taxing authorities, election tribunals, disciplinary authorities और rights decide करने वाले statutory bodies। Tribunals in India इसकी natural habitat हैं और Central Administrative Tribunal service-law का standard example है।

फिर line बदली और यह topic का सबसे important development है।

पुराना test पूछता था कि body पर duty to act judicially है या नहीं। Courts इस अलग ingredient को खोजती रहीं और harmful decisions administrative कहकर निकल जाते। England में Ridge v. Baldwin (1964) ने यह habit तोड़ी। India में A.K. Kraipak v. Union of India (1969) ने। Selection board का member खुद उसी selection का candidate था। Government ने कहा function administrative है, इसलिए natural justice apply नहीं और certiorari नहीं। Supreme Court ने कहा administrative और quasi-judicial functions के बीच line पतली होती जा रही है। Rights affect करने वाले administrative action पर भी fair होने की duty है और bias की appearance से selection vitiated है। Duty to act judicially अलग box नहीं रही, rights affect करने की power से infer होती है।

1991 तक Supreme Court ने यह अगला कदम स्वीकार कर लिया कि certiorari उन administrative authorities तक जा सकती है, जिनके decisions individuals के rights affect करते हैं। यही position लिखिए। Kraipak का reasoning है कि decision rights तय कर रहा है, तो government ने function को कोई label दिया हो, इससे court की review power तय नहीं होनी चाहिए। Quasi-judicial category को box नहीं, spectrum समझना इसी shift का point है।

फिर भी certiorari इन पर नहीं जाती:

Legislative action पर नहीं। Law या subordinate regulation pass करना dispute decide करना नहीं है। Bad law का remedy उसे unconstitutional declare कराना है, quashing writ नहीं।

Private individuals या private bodies पर नहीं, क्योंकि वे legal authority के तहत rights determine नहीं करते। Habeas corpus writs में odd one out है और certiorari ordinary side पर है।

Ministerial या purely administrative acts with no civil consequence पर नहीं, जैसे routine receipt जारी करना या register maintain करना।

Higher judiciary तक भी नहीं। Naresh Shridhar Mirajkar v. State of Maharashtra (1966) में Supreme Court ने कहा कि High Court का judicial order Article 32 में challenge नहीं हो सकता। Rupa Ashok Hurra v. Ashok Hurra (2002) में कहा कि Supreme Court के अपने final judgment को quash करने के लिए Article 32 writ नहीं है, और limited safety valve के रूप में curative petition बनाई। Court नीचे की bodies supervise कर सकती है। खुद को certiorari नहीं कर सकती।

Who can ask? Aggrieved person, यानी जिसके rights order ने affect किए हैं। यह habeas corpus और quo warranto से strict है, जहाँ stranger भी आ सकता है। Public interest litigation ने edges पर rule कुछ ढीला किया है।

Certiorari और prohibition: एक table में

दोनों twins हैं, फर्क एक है और दोनों पर लगभग हर question उसी difference का question होता है। Bodies same, grounds same, Articles same। सिर्फ़ clock अलग है।

“Issued against” row quietly काम करती है। Certiorari administrative authorities तक widen हुई। Prohibition उतनी दूर नहीं गई, क्योंकि administrative process में अक्सर रोकने के लिए pending adjudication होती ही नहीं। यही pair का सबसे important exam point है।

और दोनों alternatives नहीं हैं। Tribunal ने interim order pass किया है और case अभी चल रहा है, तो petitioner दोनों माँग सकता है: certiorari से जो pass हो चुका उसे quash और prohibition से बाकी रोकना।

इसे पढ़ें और याद कैसे रखें?

एक sentence anchor: Certiorari legality के defect पर order quash करती है, सिर्फ़ wrong होने पर नहीं। बाकी इसी से निकालिए। Order के बाद आती है, क्योंकि अस्तित्व में न आए order को quash नहीं कर सकते। Evidence reweigh नहीं करती, क्योंकि fact पर wrong होना legality defect नहीं। No evidence at all को छू सकती है, क्योंकि कुछ भी देखे बिना decision करना legality का defect है। Legislation को नहीं छूती, क्योंकि statute dispute का order नहीं है। Private body को नहीं, क्योंकि legal authority से rights तय नहीं कर रही। Administrative authority तक इसलिए पहुँची, क्योंकि rights तय करने वाला decision label कुछ भी हो, judicial nature का काम कर रहा है।

Cases के लिए चार काफ़ी हैं। Syed Yakoob (1964) तीन grounds और fact-law line। Kraipak (1969) administrative और quasi-judicial divide के collapse के लिए। Radhey Shyam v. Chhabi Nath (2015) civil courts के ख़िलाफ़ certiorari नहीं, Surya Dev Rai को correct करने के लिए। Rupa Ashok Hurra (2002) ceiling और curative petition के लिए। Error-apparent standard चाहिए तो Hari Vishnu Kamath (1955) और Satyanarayan Hegde (1960) जोड़िए।

Pair के लिए table row by row याद मत करें। Clock सीखिए। Pending equals prohibition, passed equals certiorari। बाकी difference वहीं से आता है। Administrative bodies तक certiorari क्यों पहुँची लेकिन prohibition नहीं, यह समझ लिया तो table से बेहतर pair समझते हैं।

हाँ, जब decision individuals के rights affect करता हो। Province of Bombay v. Khushaldas Advani (1950) का पुराना rule इसे judicial/quasi-judicial functions तक रखता था। A.K. Kraipak v. Union of India (1969) ने divide को पतला किया और 1991 तक Supreme Court ने rights-affecting administrative decisions पर certiorari स्वीकार कर ली। Legislative action और private bodies पर फिर भी नहीं।

क्या civil court के ख़िलाफ़ certiorari issue हो सकती है?

“Record के face पर apparent error of law” का अर्थ क्या है?

Certiorari वह writ है, जो लोगों के मनचाहे तरीके से useful होने से मना करती है। Tribunal unfair थी, तो यह काम करती है। Tribunal wrong थी, तो दरवाज़े पर रोक देती है। यह flaw नहीं, design है। अगर court हर उस order को quash कर सकती, जिससे वह असहमत है, तो वह उसी hierarchy की एक और layer बन जाती, बस slower और expensive। नीचे के tribunals फैसला करना ही बंद कर देते। इसलिए writ का सवाल narrow है: क्या body के पास power थी और उसने power को lawfully इस्तेमाल किया? यह नहीं कि answer सही था या नहीं। असहज बात यह है कि perfectly lawful order फिर भी bad हो सकता है और certiorari उसे नहीं छुएगी। यह writ में hole नहीं, judicial review की shape है। उस gap की ज़रूरत समझना topic जानने और सिर्फ़ दोहराने के बीच का फ़र्क़ है।
