The First Law Officer

The Attorney General of India (AGI) is the country's highest law officer, created by Article 76. Appointed by the President and holding office during the President's pleasure, the AGI must be qualified to be a judge of the Supreme Court.

Responsibilities

  • To give advice to the Government of India on legal matters referred by the President.
  • To perform duties of a legal character assigned by the President and to discharge functions conferred by the Constitution or any law.
  • To appear on behalf of the Union in the Supreme Court and High Courts in cases concerning the government, and in Presidential references under Article 143.

Rights and privileges

  • Right of audience in all courts in India.
  • Under Article 88, the right to speak in and take part in proceedings of both Houses of Parliament and their committees, though without a right to vote.
  • Enjoys the privileges and immunities of a Member of Parliament.

Limitations

  • Not a full-time salaried counsel; may undertake private practice but cannot advise or appear against the Government of India, defend accused persons or accept a company directorship without permission.
