President की veto powers: Absolute, Suspensive और Pocket

Indian President के absolute, suspensive, pocket और qualified veto, Articles 111, 201, money bills और recent timeline debate समझिए।

An unsigned document resting untouched in a desk tray beside a capped pen

Article 111 President

Article 111 main text में President को two options देता है और proviso में third option जोड़ता है। Two doors।

President “as soon as possible after the presentation” bill

इसलिए textbook का absolute, suspensive और pocket veto वाला trio three separate constitutional powers नहीं है।

Article 74(1) के तहत President Council of Ministers की aid और advice पर act करता है।

President’s rule in the Patiala and East Punjab States Union 1991 में President R. Venkataraman ने Members of Parliament की salary, allowances और pension बढ़ाने वाले bill पर assent रोका।

Suspensive veto: bill

Time और publicity।

Re-presentation पर “shall not withhold assent” clause second round की possibility खत्म कर देता है।

तीनों vetoes side by side

यहाँ head of state ऐसी Council of Ministers की advice पर act करता है जो Lok Sabha से आती और उसी के प्रति answerable होती है। अगर head of state को House को override करने की power दी जाए, तो government को उस majority के खिलाफ़ weapon मिल जाएगा जो उसे office में रखती है।

American pocket veto ten-day clock

Proviso में phrase है “as soon as possible after the presentation”।

Famous example Indian Post Office (Amendment) Bill, 1986 है।

Governor द्वारा reserved state bills पर President के पास लगभग unlimited veto है।

Governor bill return करे और House उसे फिर pass कर दे, तो Governor “shall not withhold assent”। इस office का discretion Article 200 and assent तथा Governor’s discretionary powers के साथ अलग पढ़िए।

State assembly bill pass करती है। State legislature presidential objection

Recent years की constitutional fight इसी gap पर है। April 2025 में Tamil Nadu की ten long-pending bills वाली petition पर two-judge Bench ने और आगे जाकर Governor तथा President के action के outer time limits तय किए और Governor का conduct illegal मानते हुए ten bills को deemed assented घोषित किया।

Main text two options देता है, assent और withhold।

Pocket veto: available है क्योंकि Article 111 कोई deadline नहीं रखता, US के ten-day rule के विपरीत।

Three illustrations काफी हैं। Narayanan और Bihar President’s rule proposal।

Pocket veto

President Lok Sabha के प्रति answerable Council of Ministers की advice पर act करता है।

क्या President उस state bill पर assent देने के लिए bound है जिसे state legislature फिर से pass कर दे?

Mains-style questions

3. Article 201 President को reserved state bills पर effectively unlimited veto देता है, जबकि Article 111 Parliament को guaranteed override देता है।

Indian veto scheme careful engineering है।
